THIS PROMOTION IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. OPEN TO LEGAL RESIDENT OF 50 UNITED STATES AND D.C. 18 YEARS OF AGE OR OLDER (19 or older in AL and NE; 21 in MS) WHO ENTER FROM WITHIN THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA.

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The “Purina Halloween Trick or Treat” Instant Win Game (the “Promotion”) begins at 12:00:00 a.m., Central Daylight Time (“CDT”) October 3, 2012, and ends at 11:59:59 p.m., (“CDT”) on October 31, 2012 ("Promotional Period"). Promotion is sponsored by Nestle Purina PetCare Company, Checkerboard Square, St. Louis, Missouri, 63164 (the "Sponsor").

Eligibility: “Purina Halloween Trick or Treat” Instant Win Game is open to all legal residents of the fifty (50) United States and the District of Columbia who have reached the age of majority in his or her state (19 in AL and NE; 21 in MS; 18 everywhere else) and are at least 18 years of age or older as of October 3, 2012. Employees, officers and representatives of Nestle Purina PetCare Company, (the “Sponsor”), their parents, affiliates, subsidiaries, agents, advertising and promotion agencies, their immediate family members (parents, children, siblings and spouses) and persons living in the same household (whether related or not), are not eligible to participate. Participation constitutes entrant's full and unconditional agreement to and acceptance of these official rules. Void where prohibited.

How to Play the Instant Win Game: During the Promotional Period, eligible participants may visit the Purina Pet Park located online at www.purinahalloween.com and click on the Trick or Treat Instant Win Game graphic. This will open a pop-up window in which participants will be prompted to enter and submit their email address to get started. They will then see a bucket of treats in which they are prompted to click on one (1) of the five (5) glowing treats. If the participant choses a winning treat they will be taken to a “Treat” page where they will be congratulated and given instructions on how to claim their prize voucher for one (1) free (up to $3.00) 6oz package of Purina® Beggin® brand Dog Snack; any variety OR one (1) 2.1oz package of Purina® Friskies® Party Mix Cat Treats, any variety.

LIMIT one (1) play per person/email address will be accepted. No mass or mechanically reproduced entries will be accepted. Participants should submit only an email address subscribed and registered in their name. Once submitted a play and cannot be deleted, canceled or modified. Participants may not play with multiple email addresses nor may participants use any other device or artifice to play multiple times or under multiple identities. Any participant who attempts to play with multiple email addresses under multiple identities or uses any device or artifice to play multiple times will be disqualified and forfeits any and all prizes won, in Sponsor's discretion. All entries become the exclusive property of Sponsor and will not be returned or acknowledged.

Instant Win Game Prizes: A total of 25,000 instant prizes are available to be won. Each prize is a voucher good for one (1) free (up to $3.00) 6oz package of Purina® Beggin® brand Dog Snack; any variety OR one (1) 2.1oz package of Purina® Friskies® Party Mix Cat Treats, any variety, redeemable at participating retail locations (“Prize”). Approximate Retail Value (ARV) of each prize is $3.00[SS1]. Total Prize Pool ARV is $75,000. Prizes are randomly time-seeded throughout the Promotional Period and awarded to the person who plays on or after the time the prize is randomly seeded. Odds of winning will depend on the total number of Instant Win Game plays received and the timing of the play during the Game Promotional Period. Promotion winners will be directed to an online registration form and asked to submit their name and mailing address to receive their prize voucher by mail. Please allow 4-6 weeks for shipment of Prize voucher after verification. Unclaimed Prizes will be not be awarded. Limit one (1) prize per person/email address.

Conditions and Limitations: No transfer or substitution of Prize is permitted and no cash equivalent is offered. If a Prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute Prize with another prize of equal or greater value. In no event shall more Prizes be awarded than the number stated in the “Instant Win Game Prizes” section above. If more prize claims are received than prizes available, a random drawing may be conducted to award advertised number of prizes. Potential winners are subject to verification, including verification of age. If a potential winner is found not to be eligible or not in compliance with these Official Rules, or if prize notification or any Prize is returned as undeliverable, the potential winner may be disqualified, in Sponsor’s sole discretion. All federal, state and local taxes are the sole responsibility of winner, regardless of whether Prize is used in whole or in part. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of participants. Acceptance of a Prize constitutes permission (and winner agrees to confirm permission in writing if requested) for the Sponsor and its agencies to use winners’ names and/or likeness for advertising and publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations, without further compensation, except where prohibited by law. Participants of this promotion agree to be bound by these Official Rules and agree that any dispute with regard to the conduct of this Promotion, rule interpretation or award of prize shall be submitted in writing to the Sponsor whose decision shall be binding and final. Noncompliance with any of the foregoing may result in disqualification. Sponsor and its subsidiaries, affiliates, directors, officers, employees and agents (“Released Parties”) and each of their designees and assignees and all of their respective officers, directors, employees, representatives and agents shall have no liability and will be held harmless by entrant for any liability, loss, injury or damage to themselves or any other person or entity, including personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any of the prizes or participation in this Instant Win Game. Sponsor reserves the right to modify, terminate or suspend the Instant Win Game should an action or event beyond the reasonable control of Sponsor corrupt or impair the administration, security or fairness or proper play of the Instant Win Game, and Sponsor reserves the right to select winners from all eligible, non-suspect entries received prior to such action.

Internet Limitations of Liability: If for any reason this Promotion is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the play process, and/or to cancel, terminate, modify or suspend the Promotion in whole or in part. Sponsor is not responsible for lost, late, stolen, misdirected, incomplete or illegible entries. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for incorrect or inaccurate play information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Promotion, or any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or play to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Promotion or downloading any materials in this Promotion. Any attempts by an individual to access the Promotion via a bot script or other brute-force attack will result in that IP address becoming ineligible and such individual and their entries may be disqualified. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning play will be declared by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Use of Data: By participating in this Promotion, each participant agrees to Sponsor’s use of participant’s personal information as described in the Sponsor’s Privacy Policy, located at http://www.purina.com/General/Privacy.aspx.

Terms & Conditions: This Promotion is subject to all applicable federal, state, and local laws. By entering the Promotion, entrants agree to release, discharge, indemnify and hold harmless the Released Parties, and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Promotion or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Promotion mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to be bound by these Official Rules and waive any right to claim ambiguity in Promotion or these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules. This Promotion is void where prohibited.

Disputes: As a condition of participating, participants agree (and agree to confirm in writing): (a) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (b) all causes of action arising out of or connected with this Promotion, or any Prize awarded, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. By participating, each participant agrees all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules (whether of the State of Missouri or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Missouri. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in St. Louis County or St. Louis, Missouri.
